6014 Eleventh Avenue Realty v. 6014 AH LLC, Alexander Hirsh a/k/a Alexander Hirsch, et al, (unpublished opinion, [Sup Ct., Kings Cty, 2011])

In this case, we represented the Plaintiff owner of a commercial building.  The Defendants were the ground tenant and the personal guarantor under the lease.

The Defendants stopped paying rent under the lease and owed substantial rent arrears.

We made a motion to amend the complaint to add a cause of action for ejectment, to add the sub-tenants and to make the ground-tenant and the guarantor pay rent during the lawsuit.

The Supreme Court, Kings County granted our motion and ordered the tenant and guarantor to pay $15,000.00 per month during the lawsuit without prejudice to what was actually owed to our client.
